The place to start is with this first checklist. This is a step-by-step guide to the whole process.

Here, things are broken down by what you’ll need to do in the First Few Days, First Month, Months Three to Twelve, and finally in the Second Year and Beyond.

For example, in the very beginning, you’ll need to call the hospice nurse for a declaration of death.

You’ll need to arrange for cremation or burial, and you’ll want to get certified copies of the death certificate because you’ll need several of those later.

Then you’ll need to secure their home and vehicles and you’ll need to locate their will and financial records.

Then, sometime in the first month, you’ll need to determine whether the estate will need to be probated, and if so, file the necessary forms with your local probate court. (And we have resources to help you out with that.)

Whether you need to file for probate or not, you’ll want to prepare a detailed inventory of the estate’s assets and liabilities.

And this is also when you’ll want to write and submit an obituary and plan their memorial.

Over the next few months, you’ll need to pay all the undisputed debts, pay any estate tax that may be due, and submit any disputed claims to the probate court for resolution.

Finally, if you’ve had to probate the estate, you’ll want to file your proposed Final Distribution and Accounting, and eventually, get your Final Discharge order.

Of course, you’ll need more detailed checklists for each phase and we have them for you. Here’s the checklist for the first few days. That’s when you’ll need to notify others, secure the deceased’s property, take steps to prevent identity theft, arrange for burial or cremation, and plan the funeral.

A Special Note About Estates Under $250K

What you should know about the potentially high cost of settling a small estate

Middle-class families with smaller estates often pay the highest executor fees in America, as a percentage of the estate, according to research conducted by the firm Estate Exec.

According to that study, while the average estate in America is valued at roughly $350,000 and incurs executor fees of about $18,000 (a little over 5% of the estate), estates valued between $50,000 and $250,000, however, spend an average of $15,900 on executor fees or 10.6% of the estate.

Even worse, smaller estates – typically those managed by family members not familiar with the process – are charged even more. Those estates, with assets valued between only $10,000 and $50,000, pay out an average of $23,500.

That could be anywhere from nearly half of an estate’s entire value to over twice its value, taking a massive bite out of what the heirs receive, and possibly even costing them tens of thousands of dollars over and above the value of the estate.

The sad irony is that many, if not most, small estates are simple enough that they can be probated by a family member without the need for a lawyer or an outside executor.
